Before getting the Social Security Disability benefits that you rightfully deserve, your claim will likely be denied at least one time. Most claims are denied a second time. Q. When can I expect a Social Security Hearing?

A. There are a large number of Social Security Appeals and it is often many months before each level of an appeal is decided. You are generally given four to six (4- 6) weeks notice before an Administrative Law Judge (ALJ) hearing and you will be expected to attend that hearing unless you have an extraordinary reason why you cannot attend. The exact number of months between appeals varies from case to case and there is little that can be done by you or your lawyer to speed up the process due to the huge backlog of cases waiting for a hearing. Once a hearing is held, the ALJ will render a decision within a few months of the hearing.

Q. Why won’t SS pay for my disability without an ALJ Hearing?

A very small number of applicants are awarded benefits in North Carolina before the ALJ hearing. Social Security decisions and opinions prior to the ALJ hearing are generally made by people who have never seen or talked to you. Many SS doctors will give opinions on your physical condition without the benefit of an actual exam. It is extremely important for you to maintain a good relationship with your treating doctor and to fully explain the reasons you are applying for Social Security. If you are persistent and have evidence of your medical disability, you will get the benefits you are entitled to.

Q. How much will a lawyer cost me?

The ALJ must approve any fee charged by a lawyer. Lawyers will take Social Security cases on a contingency or percentage (%) basis. The standard percentage is twenty-five percent (25%) of any past-due benefits you might be entitled to. If your claim is rejected by the ALJ, you will not owe any money for attorney fees. Although if you lose, you are still obligated to pay any "out of pocket" expenses such as costs to obtain medical reports, copies, long distance phone calls and other related calls. No fees will be charged on future benefit payments.

Q. How long will it take to start receiving Social Security Disability payments?

The period of time it takes for you to start receiving your Social Security Disability payments will depend on whether your initial application for benefits is approved or denied. After you file your initial application for Social Security Disability, it usually takes three (3) to (5) months for the Disability Determination Services to make a decision regarding your claim. In some situations, Disability Determination Services may need more information regarding your medical condition in order to process your claim and the agency may refer to you, at its expense, to a doctor or psychologist for further examination or testing. In recent years, it has become increasingly difficult for people to be approved for disability benefits. According to the Social Security Administration’s statistics, seven (7) out...

Q. What type of physical ailments are considered disabling under SS law?

A. SS law reviews the overall impact of your cumulative ailments in deciding whether you are disabled or not. A review of your age, education, past work experience, and vocational possibilities will all be considered in deciding your disability. The key to the question is whether your overall physical and/or mental health makes it difficult for you to hold down regular work in the national job market. SS considers medical, vocational, and personal factors in making the decision.

Q. Does SS disability pay for my medical bills?

A. Not immediately. If you are receiving Disability Insurance Benefits, Disabled Widows or Widowers Benefits or Disabled Adult Child Benefits, you must wait for twenty-four (24) months before qualifying for Medicare, which will pay most of your medical expenses. Medicare pays for doctors visits and for acute care in a hospital, among other things. You are responsible for deductibles and co-payments. Prescription costs will be partially paid by Medicare beginning in 2006 under a very complicated procedure.
