Workers' Compensation (WC) is an administrative system set up by the North Carolina General Assembly to compensate workers who get injured by an accident on the job or develop a disease caused by their job. The system generally provides the worker with compensation even if the worker was partially at fault. The N.C. Industrial Commission (IC) is the Court that handles WC cases.

If you have been injured at work, report the injury immediately. This is an extremely crucial step in ensuring your work injury claim meets the requirements established by the North Carolina Industrial Commission (IC) and the General Assembly. Workers' compensation applications are often denied initially because the injured worker did not give timely notice. This means you must inform your employer of your injuries in writing within 30 days. Even if you miss this deadline, file your claim as soon as you can.

Aggravation of Preexisting Conditions

FREQUENTLY ASKED WORKERS' COMPENSATION QUESTIONS

Q. When am I eligible to receive Workers’ Compensation benefits?

A. Regardless of whether you miss any time from work, you are entitled to have your medical expenses paid by the Workers’ Compensation insurance carrier. When your work injury causes you to miss more than one (1) week of work, you are entitled to receive 2/3 of your gross average wages until you are able to return to work. Once you have missed one (1) month of work, you will also be paid for that first week.

Q. Can I be disabled under WC guidelines if the only problems I have are psychological in nature?

A. Yes. WC law recognizes mental or physical ailments that prevent you from working at your pre injury job or other “suitable” employment making similar earnings. Disability that results from pure mental difficulties are compensable but generally have to be supported by treating mental health care professionals.

Can my employer fire me while I am on WC?

Retaliatory Employment Discrimination Act (REDA) protects employees who file WC claims. This law allows employees to sue the employer for monetary damages if the employer fires, demotes, punishes or takes any retaliatory action against the employee just because the employee files or testifies in a workers' compensation case. An attorney can give you the correct form to file a REDA complaint with the Department of Labor or you may call the Department of Labor at 1-800-522-6762.

Do Undocumented Workers Qualify for Workers Compensation?

Immigration reform and enforcement of immigration laws have become a political hot topic, especially in light of Arizona’s enactment of several laws aimed at getting more undocumented residents to leave the state. In North Carolina, that debate hasn’t impacted the state’s workers' compensation laws. Under §97-2 of the state’s Workers' Compensation Act, the definition of “employee” states in part, (E)very person engaged in an employment under any appointment or contract of hire or apprenticeship, express or implied, oral or written, including aliens, and also minors, whether lawfully or unlawfully employed, but excluding persons whose employment is both casual and not in the course of the trade, business, profession, or occupation of his employer… The key language is that the law covers “aliens…whether lawfully or unlawfully employed…” Big picture, national immigration issues took a back seat (if they were thought of at all) when the legislature wrote this section and when...

Q. What injuries are covered by Workers’ Compensation?

A. Workers’ Compensation law covers any accident on the job. An “accident” covered by Workers’ Compensation law includes any unusual or unexpected injury, not only accidents in the sense most of us think of them. Health problems related to work conditions that are developed over time are also covered. Back injuries that can be traced to work are also covered under NC law. You should consult a qualified lawyer to determine whether your work injury is covered by Workers’ Compensation law.

What time limit do I have to file WC?

As soon as possible, you should file a Form 18, Notice of Accident, with the IC and employer, informing them that you wish to make a claim. While N.C. law requires this Form 18 to be filed within 30 days, an absolute time limit of 2 years may be applicable to your claim depending on the facts. After your claim is settled, time limits also exist for reopening the case. This form can be obtained by e-mailing our office or calling the IC at 828-348-4107.
