For over 33 years (nearly 40 now) I represented people in Western North Carolina on their Social Security and workers’ comp cases.  I understand what it is like to lose a job. I understand what it’s like to not be able to work. I’ve been at work since I was 14 years old. FREQUENTLY ASKED SOCIAL SECURITY DISABILITY QUESTIONS

Q. Once I am approved for SSD, will I be reviewed for continued disability?

A. Probably. You have an ongoing requirement to report any earned income while you draw SS disability checks. SS will not terminate your benefits unless your medical condition has improved. Most people who have their cases reviewed continue to get benefits. If Social Security proposes to end your benefits, you have the right to appeal their decision. If you appeal within ten (10) days of being notified of their decision, you can ask Social Security to continue your benefits while your appeal is pending.

Q. What is an Administrative Law Judge Hearing?

SS hearings are held by a judge called an Administrative Law Judge (ALJ). The Western North Carolina area has been blessed with very competent and reasonable ALJs. The hearings are relatively informal and have no District Attorney or U.S. Attorney on the "other side" trying to trick or confuse you. Some ALJs will ask questions, some will let your lawyer ask all the questions. Your testimony to the ALJ should emphasize specific physical and/or mental problems and how these ailments prevent you from working. The ALJ will hear all the evidence and make a decision based on your medical records and testimony heard at the hearing. Sometimes, the ALJ will request a Vocational Expert or Medical Advisor to testify. No jury or other panel will...

Q. Can I draw Social Security if I have never worked full time?

A. Yes. If you are unable to work at any job for a period of twelve (12) months or more AND have financial need, you may be eligible for Supplemental Security Income (SSI). SSI is a special program of the Social Security Administration that provides benefits to individuals who have not worked on a full time basis. Even if you have worked in the past, you might be eligible for SSI. You should consult a qualified lawyer to understand the types of Social Security programs for which you may be eligible.

Q. How long will it take to start receiving Social Security Disability payments?

The period of time it takes for you to start receiving your Social Security Disability payments will depend on whether your initial application for benefits is approved or denied. After you file your initial application for Social Security Disability, it usually takes three (3) to (5) months for the Disability Determination Services to make a decision regarding your claim. In some situations, Disability Determination Services may need more information regarding your medical condition in order to process your claim and the agency may refer to you, at its expense, to a doctor or psychologist for further examination or testing. In recent years, it has become increasingly difficult for people to be approved for disability benefits. According to the Social Security Administration’s statistics, seven (7) out...

Q. If I win my SS disability case, how much “back pay” will I get?

A. The exact amount of “back pay” will be determined by which SS program you are eligible for. The two (2) main SS disability programs are SSD and SSI. For SSD (benefits based on the taxes you paid in), benefits can’t be paid for more that one (1) year prior to the month your claim was filed. The first five (5) months of that period are withheld as a waiting period. For SSI benefits based on financial need, the “back pay” will begin on the date you filed for disability. While getting SS approval may actually take a few years, the “back pay” will be retroactive to these dates.

Q. Should I apply for Social Security when I am receiving Workers’ Compensation benefits?

A. Generally, yes. Social Security law requires that you be disabled for a period of twelve (12) months or more. You become eligible for Workers’ Compensation weekly checks when you miss more than one (1) week of work. If you believe that you might miss more than twelve (12) months of work, you should apply for Social Security. Since you may be forced to wait over one (1) year to receive Social Security benefits, you should apply for these benefits unless you are positive you will return to work within the twelve (12) month period. The interaction between Workers’ Compensation and Social Security benefits is very complicated. You should consult a qualified lawyer to make sure you coordinate the receipt of these benefits.
