NC Workers’ Compensation Elements of Settlement

There are several parts to a workers’ comp case. First of all, you get paid two-thirds of what you were making for every week you’re out of work. The second thing you are entitled to is to get all of your medical bills paid. And the third thing you’re entitled to is some type of final settlement. Now when you do your final settlement there are several ways you can settle. The first way is called a “clincher”. That’s a pretty drastic thing to do which most settlements are done in clincher form. The clincher also takes away your existing right to make an additional claim within the next two years. So they are basically buying out your right to make a claim on your existing injury for the next two years. They should pay you some more money for the clincher. Other ways to settle it is just to settle on your rating or to settle on your condition at the time and keep those two years open. FREQUENTLY ASKED WORKERS' COMPENSATION QUESTIONS

What time limit do I have to file WC?

As soon as possible, you should file a Form 18, Notice of Accident, with the IC and employer, informing them that you wish to make a claim. While N.C. law requires this Form 18 to be filed within 30 days, an absolute time limit of 2 years may be applicable to your claim depending on the facts. After your claim is settled, time limits also exist for reopening the case. This form can be obtained by e-mailing our office or calling the IC at 828-348-4107.

Q. What if my workers’ compensation doctor assigns a permanent partial impairment (P.I.) rating for my injury?

A. When a doctor releases you from care, a permanent disability rating may be assigned to your injured body part. A rating means that you will never again be 100% healthy in that body part. Whether you can return to work depends on the severity of your injury and how that injury affects your ability to handle the physical demands of your work. If you are able to return to making the same wages as before your work injury, this rating may be your only compensation. However, if you are not able to earn the same pre-injury wages, your rating will not represent your only compensation. Your impairment rating is only one factor the Industrial Commission and NC Law will consider in determining what damages the work injury caused you. NC Law permits you to select the most favorable method or compensating you for the injuries and loss of earning...

Q. Who provides and directs medical treatment resulting from a workers’ compensation accident?

A. The employer or its insurance company, subject to any NC Industrial Commission orders, provides, and directs medical treatment. The NC Industrial Commission may permit the employee to change physicians or approve a physician of employee's selection when good grounds are shown. However, payment by the employer or carrier is not guaranteed unless written permission to change physicians is obtained from the employer, carrier, or Commission before the treatment is rendered.

Q. What can I do if my workers’ compensation checks are late?

A. You should call the insurance carrier and ask (1) whether your check was mailed? and (2) if so, when it was mailed?. Weekly workers’ compensation checks are generally late because either the postal service is slow or your check has "fallen off the diary". Insurance company program computer to print checks according to an automatic diary for a specific number of weeks. When that number of weeks is over, your check “falls off the diary” and must be reset for additional weeks if checks continue to be due. An immediate call to the insurance adjuster should be sufficient to reset the check diary. If checks are regularly late, you should consult a qualified lawyer to take more aggressive action through the NC Industrial Commission.

Q. How do lawyers get paid for handling WC cases?

A. Generally, lawyers will charge a contingent fee of 25% of the settlement. Contingent fees are payable only if the case is successful. While most fees are set at the settlement of the case, some fees are collected while the claim is pending. Charging legal fees at any time without approval of the NC Industrial Commission is a Class 1 misdemeanor crime in our State. Most lawyers will advance the expenses of a claim with the understanding that these costs will be recovered when the matter is settled.

Q. Do I have to allow my Rehabilitation Provider in the examining room while I am being examined by my doctor for a workers’ compensation claim?

A. No. Workers have an absolute right to a private examination by their doctors. The NC Industrial Commission does encourage the worker to allow the provider to meet with both the worker and the doctor immediately following the examination when the doctor discusses his/her findings and makes his/her recommendations for treatment. This will allow everyone to be aware of and understand treatment plans and expectations.
