Q. Do I have any chance of winning a SS disability case when I am a young person?

A. Yes. While age is an extremely important consideration in deciding disability cases, the SS office will also look at education, job experience, and vocational possibilities in a national job market. Naturally, the younger claimants are considered employable for more types of jobs requiring retraining, classes, relocation, and other adjustments than older claimants. Don’t give up if you feel your mental and/or physical disability keeps you from working at “substantial gainful activity” for a period of twelve (12) months or more.

Q. What if my disability is caused by drugs and/or alcohol?

A. Congress has passed legislation that severely limits the receipt of Social Security (SS) benefits if your substance abuse problems contribute to your disability. While the current law is very unfavorable to these types of claims, careful analysis by an experienced lawyer may help you find other grounds that are legitimate reasons to qualify for SS benefits.

Q. What should I do when Social Security denies my claim?

A. Most claimants are denied several times before they receive a favorable decision on their claim. DO NOT GIVE UP. Your best opportunity to prove your disability occurs with a lawyer at an Administrative Law Judge (ALJ) hearing. You have paid Social Security taxes for years and should aggressively pursue your rights to get Social Security benefits.

Q. Are children eligible for Social Security?

A. Yes. Children may be eligible for several different types of Social Security programs. While most people consider “regular” Social Security as the program based on taxes paid while working, several other programs exist to aid qualified children who meet other requirements such as financial need, disabled or deceased parent. Even adult children (over the age of 18) may qualify for benefits under some circumstances. Staff at the Social Security Administration local office are very cooperative and helpful in reviewing what programs a child with special needs might be eligible for. If the child’s application is filed and denied by Social Security, the family should consult with a qualified lawyer to help present evidence and testimony to support the claim.

Q. Once I am approved for SSD, will I be reviewed for continued disability?

A. Probably. You have an ongoing requirement to report any earned income while you draw SS disability checks. SS will not terminate your benefits unless your medical condition has improved. Most people who have their cases reviewed continue to get benefits. If Social Security proposes to end your benefits, you have the right to appeal their decision. If you appeal within ten (10) days of being notified of their decision, you can ask Social Security to continue your benefits while your appeal is pending.

Q. Can I draw private disability checks while also receiving Social Security checks for disability?

A. Yes. The terms of your private disability checks are contractual and control whether these payments are pro-rated or changed by the receipt of Social Security checks. Federal law requires full payment of Social Security disability checks regardless of the receipt of private disability checks for the same disability. However, most private disability plans have contractual provisions requiring repayment and/or discounts of compensation paid when SS disability check commence.

Q. What is the difference between SS and SSI?

Both SS and SSI benefits have the same requirements for disability--the inability to work at a suitable job for a continuous period of twelve (12) months or more. SS benefits (also called Title II) are based on the amount of SS taxes you have paid in the system for the ten (10) year period before you became disabled. SS benefits are generally higher than SSI benefits. Dependents of SS recipients may also be entitled to benefits. You should report any dependants to SSA even if they do not live with you. SSI benefits (also called Title XVI) are based on a financial need. You may be eligible for SSI benefits even if you have never worked or paid SS taxes in your life. Generally SSA...
