At the David Gantt Law Office in Asheville, North Carolina, we understand you may be facing financial hardship as a result of the slow application and appeals process. Our law firm offers efficient services, doing everything we can to make the Social Security claim process less stressful for you and your family. We urge you to contact us as soon as your initial claim is denied. We offer free consultations and contingent attorneys’ fees.
We can guide you through SSD appeals and reconsideration.
The initial denial of your Social Security disability claim is a key date used in determining your past due benefits. You will have 60 days to file for reconsideration. Your claim will be reviewed and more medical information will be gathered. This reconsideration could take anywhere from two to eight months.
If you are denied a second time, you will have 60 days to appeal the decision. A hearing before an administrative law judge (ALJ) will then be requested. This hearing can occur up to two years after the request. The majority of SSD claims are approved at the ALJ hearing after review of your medical records and testimony.
It is important to remain optimistic during this frustrating process. Do not give up. Most applicants are denied several times. David represents clients during the entire process, including at the ALJ hearing, if necessary. You pay into your SSD taxes, and you are entitled to receive these benefits.
