North Carolina law covers back injuries. It has always covered back injuries when you slip and have an accident; you slip on a banana peel and hurt your back or you fall off a ladder.  North Carolina law has also in the General Assembly several years ago increased the coverage of back injuries to include a concept called “specific traumatic injury.”  Specific traumatic injuries mean that you don’t have an accident that happens in an instant, but you do have a back injury over time. Now if you back gets injured over 20 years of hard work, that’s not what they’re talking about. They are talking about a pretty limited period of time where you can pinpoint your back got hurt during that activity. There’s no time set for this, but I think the more compact the time or the shorter the time period, the better your chances of winning your case.  It is a complicated area of law and there are hundreds of cases interpreting what is too long and what is not long enough. FREQUENTLY ASKED WORKERS' COMPENSATION QUESTIONS

Q. Are back injuries that are not “accidents” covered by Workers’ Compensation?

A. Yes. Generally, a work injury must be an “accident” to be compensable. Back injuries do not have to meet this requirement. NC law accepts back injuries that do not result from “accidents” if the worker can trace the injury to a “specific traumatic incident.” The more precise the time of the incident, the more likely the back injury claim will be compensable. ANY back injury should be prompted reported and checked out by a qualified physician. The details of the incident should be given very carefully and completely to both employer and medical providers. Many back injuries do not become symptomatic until several days later.

Q. How do lawyers get paid for handling WC cases?

A. Generally, lawyers will charge a contingent fee of 25% of the settlement. Contingent fees are payable only if the case is successful. While most fees are set at the settlement of the case, some fees are collected while the claim is pending. Charging legal fees at any time without approval of the NC Industrial Commission is a Class 1 misdemeanor crime in our State. Most lawyers will advance the expenses of a claim with the understanding that these costs will be recovered when the matter is settled.

How do I pay my lawyer?

All charges for legal services must be approved by the IC. Generally, lawyers charge a 25% flat fee for their services on WC cases. This fee is payable only if: Your claim is successful; and The IC approves the fee. Most lawyers also charge for copies, medical records received from medical providers, long distance calls and other expenses of handling your claim. These costs are usually owed whether or not your claim is successful.

Q. What if I am able to work after my workers’ compensation injury, but my earnings are significantly less than before my injury?

A. If you return to a job paying significantly less wages than pre-accident wages, you may be entitled to 66 2/3% of the wage differential. Since NC Law is based on actual earning capacity, a loss of ability to make money might be compensable. Claims based on lower earning capacity are difficult to prove and quantify. Most successful claims under this theory of WC Law require testimony from experts in the field of vocational analysis and labor markets.

Q. What type of physical ailments are considered disabling under WC law?

A. The key to the question of whether you are disabled under WC law or not is based on how the physical or mental ailment(s) you have impact your ability to earn money. No exact listing or threshold exists in NC law for what determines a disability. If you are unable to work at the same job you held down before the accident, you are likely disabled under our law. NC law recognizes both physical and mental disabilities.

Q. Can I draw Workers’ Compensation weekly checks and Social Security checks at the same time?

A. Yes, but your Social Security check will be reduced or offset by the amount of your Workers’ Compensation check. Social Security law mandates an offset of disability checks when your combined income totals 80% of more of your pre injury earnings. Federal law requires that you report all income or benefits that you receive while receiving Social Security checks. The offset or reduction in Social Security benefits can be lessened or minimized by careful planning and legal wording in your Workers’ Compensation settlement. You should consult a qualified lawyer to help you maximize your payments from each source.
