FREQUENTLY ASKED SOCIAL SECURITY DISABILITY QUESTIONS

Q. What happens if I try to work when I am receiving Social Security benefits?

A. Social Security law requires that you report any income or benefits while you are receiving checks. You cannot work and be disabled at the same time. However, Social Security law permits you to make some efforts to work without jeopardizing your eligibility. If you fail to report any earnings made while trying to work, your Social Security check could be terminated. The law on making work attempts is complicated and changes on a regular basis. You should consult a qualified lawyer before deciding how you approach this issue.

Q. What if my disability is caused by alcohol or drugs?

Congress has passed legislation that severely limits the receipt of SS benefits if your substance abuse problems contribute to your disability. While the current law is very unfavorable to these types of claims, careful analysis by an experienced lawyer may help you to find other grounds that are legitimate reasons to qualify for SS benefits.

Q. Am I eligible for SS disability if my ailment is not permanent?

A. Yes. SS law requires only that the disabling condition (1) result in death OR (2) exist for a period of twelve (12) months or more. No part of SS requires the disabling condition to be permanent. While many disabling ailments are permanent, the law does not require any duration longer than twelve (12) months.

Q. Once I am approved for SSD, will I be reviewed for continued disability?

A. Probably. You have an ongoing requirement to report any earned income while you draw SS disability checks. SS will not terminate your benefits unless your medical condition has improved. Most people who have their cases reviewed continue to get benefits. If Social Security proposes to end your benefits, you have the right to appeal their decision. If you appeal within ten (10) days of being notified of their decision, you can ask Social Security to continue your benefits while your appeal is pending.

Q. Are children eligible for Social Security?

A. Yes. Children may be eligible for several different types of Social Security programs. While most people consider “regular” Social Security as the program based on taxes paid while working, several other programs exist to aid qualified children who meet other requirements such as financial need, disabled or deceased parent. Even adult children (over the age of 18) may qualify for benefits under some circumstances. Staff at the Social Security Administration local office are very cooperative and helpful in reviewing what programs a child with special needs might be eligible for. If the child’s application is filed and denied by Social Security, the family should consult with a qualified lawyer to help present evidence and testimony to support the claim.

Q. Can I draw private disability checks while also receiving Social Security checks for disability?

A. Yes. The terms of your private disability checks are contractual and control whether these payments are pro-rated or changed by the receipt of Social Security checks. Federal law requires full payment of Social Security disability checks regardless of the receipt of private disability checks for the same disability. However, most private disability plans have contractual provisions requiring repayment and/or discounts of compensation paid when SS disability check commence.
