Q. What witnesses or evidence will I need at the hearing?

Since most of the issues for hearing involve medical questions, medical reports from your treating doctors are critical. Doctors are not asked to attend SS hearings. ALJs will not decide the claim based on the number of witnesses. You should consult with your lawyer about the witnesses you need as well as the questions you will be asked.

Q. What if I am getting Workers' Compensation benefits?

SS law requires that all other benefits you receive be accounted for. This accounting normally means that SS benefits are offset or reduced by the other benefits you receive. While Federal law requires you to report all payments you receive, the offset can often be lessened or eliminated with very careful planning and legal wording in your Workers' Compensation settlement. You should consult your lawyer for proper wording.

Q. What is an Administrative Law Judge Social Security Hearing?

A. Social Security hearings are held by a judge called an Administrative Law Judge (ALJ). The hearings are relatively informal and have no District Attorney or U.S. Attorney present representing Social Security. Some ALJs will ask questions, some will let your lawyer ask all the questions. All you should do is tell the ALJ what is wrong with you and why you are unable to return to work. The ALJ will hear all the evidence and make a decision based on your medical records and testimony heard at the hearing. Sometimes the ALJ will request a Vocational or Medical Expert to testify regarding hypothetical circumstances regarding your condition(s). Your lawyer should help you understand the issues, expected testimony and procedure.

Q. Can I be disabled under SS guidelines if the only problems I have are psychological in nature?

A. Yes. SS law requires a consideration of mental as well as physical factors in deciding disability. The key to establishing disability is the proof that the disability condition continue at least twelve (12) months or more. Mental ailments that have or are expected to last more than twelve (12) months qualify for disability if the condition is supported by mental health professionals. Disability does not have to be permanent for mental or physical conditions.

Q. What is the difference between Social Security and SSI?

A. Both Social Security Disability (SSD) and Supplemental Security Income (SSI) are programs of the Social Security Administration. Both SSD and SSI require the same basic requirement for coverage- an inability to work at any job for a period of twelve (12) months or more. SSD benefits are based on the taxes you have paid into the system before you became disabled. SSI benefits are based on financial need.

Q. What if my disability is caused by alcohol or drugs?

Congress has passed legislation that severely limits the receipt of SS benefits if your substance abuse problems contribute to your disability. While the current law is very unfavorable to these types of claims, careful analysis by an experienced lawyer may help you to find other grounds that are legitimate reasons to qualify for SS benefits.

Q. How do I qualify for Social Security disability benefits?

A. You are eligible for Social Security disability benefits WHEN you have mental and/or physical problems severe enough to keep you from working for a period of twelve (12) months or more. You must be unable to work at any competitive job in the national economy, not just the one you had before your disability. Your age, education, past work experience, and ability to perform other jobs are among the factors that the Social Security Administration will consider in deciding your disability.
