You can draw Social Security whether you’ve worked at all.  There are two types of programs. There is one that is based on the taxes you paid in during the 10 years before you become disabled. There’s another one that’s based on financial need.  You don’t have to work at all to draw the one on financial need if you qualify for the overall disability benefit. Q. What happens if I try to work when I am receiving Social Security benefits?

A. Social Security law requires that you report any income or benefits while you are receiving checks. You cannot work and be disabled at the same time. However, Social Security law permits you to make some efforts to work without jeopardizing your eligibility. If you fail to report any earnings made while trying to work, your Social Security check could be terminated. The law on making work attempts is complicated and changes on a regular basis. You should consult a qualified lawyer before deciding how you approach this issue.

A. Most claimants are denied several times before they receive a favorable decision on their claim. DO NOT GIVE UP. Your best opportunity to prove your disability occurs with a lawyer at an Administrative Law Judge (ALJ) hearing. You have paid Social Security taxes for years and should aggressively pursue your rights to get Social Security benefits.

Q. How long will it take to start receiving Social Security Disability payments?

The period of time it takes for you to start receiving your Social Security Disability payments will depend on whether your initial application for benefits is approved or denied. After you file your initial application for Social Security Disability, it usually takes three (3) to (5) months for the Disability Determination Services to make a decision regarding your claim. In some situations, Disability Determination Services may need more information regarding your medical condition in order to process your claim and the agency may refer to you, at its expense, to a doctor or psychologist for further examination or testing. Q. What is an Administrative Law Judge Hearing?

SS hearings are held by a judge called an Administrative Law Judge (ALJ). The Western North Carolina area has been blessed with very competent and reasonable ALJs. The hearings are relatively informal and have no District Attorney or U.S. Attorney on the "other side" trying to trick or confuse you. Some ALJs will ask questions, some will let your lawyer ask all the questions. Your testimony to the ALJ should emphasize specific physical and/or mental problems and how these ailments prevent you from working. The ALJ will hear all the evidence and make a decision based on your medical records and testimony heard at the hearing. Q. Why won’t Social Security pay for my disability without an Administrative Law Judge (ALJ) Hearing?

A. A very small number of applicants are awarded benefits in North Carolina before the ALJ hearing. Social Security (SS) decisions and opinions prior to the ALJ hearing are generally made by people who have never seen or talked to you. Many SS doctors will give opinions on your physical condition without the benefit of an actual exam. It is extremely important for you to maintain a good relationship with your treating doctor and to fully explain the reasons you are applying for Social Security. If you are persistent and have evidence of your medical disability, you will get your disability benefits.
